Many company managers are only confronted with the legal requirements when they receive a notice from the municipality or, in the worst case, a decision on a fine of up to one million forints. There are three main legal categories of placement of advertising media. In our experience, most refusals and fines result from the selection of the wrong procedure. We can help you navigate the concepts.

This is the most common type of procedure our customers encounter. The municipalities (in Budapest, the districts) regulate by decree the size, material and appearance of the signs that can be placed on the facades of buildings.

  • When is it needed? Almost every time a change is made to the façade of a building (e.g. new signage, portal colouring, foiling, installation of a light box).
  • What is the Chief Architect investigating? The fit of the sign into the streetscape, colour harmony, use of materials (e.g. plastic vs. metal), typography and method of fixing.
  • The Bepro solution: Our engineers and graphic designers will prepare the necessary technical documentation, including day and night photomontage (visual plan), detailed technical specifications and a façade drawing scaled to the required 1:50 or 1:100 scale.

If the advertising device (e.g. a perpendicular sign, stop sign, totem pole) is physically located in public space or extends more than 10 cm in the air above public space, a public space use contract must be concluded with the owner (usually the municipality).

  • Financial implications: This is not a one-off procedural fee, but a regular (monthly or annual) payment obligation. The fees vary by district and zone.
  • Exceptions: In some districts, flush-mounted signs on the facade (if they do not encroach into the public space) may be exempt from the fee, but notification is still required.

Above a certain size or structural design, the advertising medium is considered a building.

  • When do you need it? For example, advertising towers with independent support structures, totem poles over 6 metres high, or large roof advertisements that place a significant load on the support structure.
  • The process: This requires the involvement of a qualified architect and structural engineer. Bepro’s engineering team will provide the structural calculations and construction plans for uploading to the ÉTDR system.

Benyújtás és Ügykövetés:

Speciális Esetek és Tiltások – Mit Nem Szabad?

There are many pitfalls in the authorisation procedures. To avoid fines, it is important to be aware of the most common prohibitions and restrictions:

  • Protection of historic monuments: On protected buildings, in historic city centres (e.g. Castle District, Andrassy Avenue), the use of backlit box letters or large, homogeneous illuminated signs is generally prohibited. Here, only sophisticated, coloured metal (copper, stainless steel), glass or individual, indirectly illuminated (surroluminescent) solutions are permitted.   • Transport safety: It is strictly forbidden to place advertising which may be confused with road signs in form, colour or placement. Flashing, illuminated advertising near roads is generally prohibited as it distracts drivers.

  • Unfurled banners: Most town and country planning regulations now prohibit or severely restrict the installation of tarpaulins and banners on building facades and balconies, as they detract from the aesthetic appearance of the townscape.

Q: How long does it take to get a permit?

V: The formal administrative deadline for the registration procedure is usually 15 days. However, the process may be longer if a gap needs to be filled or if a planning council resolution is required (in priority locations). The turnaround time for public land use permits can be 30-60 days, depending on the district. We recommend starting the process at least 2 months before the planned opening.

Q: What is the fine for unauthorised signs?

V: The amount of the town and country planning fine is significant. It can reach HUF 200,000 for natural persons and up to HUF 1,000,000 for companies and legal entities. It is important to note that the fine may be imposed several times during the duration of the infringement (“repeated fines”) and the authority may order the forced removal of the sign at the owner’s expense.

Q: Do I need a licence for every sign?

V: A 2006. Act V of 2007 on the Trade Register provides for the display of a signboard at the registered office. Although the existence of the sign is a legal obligation, the placement of the sign How (size, colour, location) will continue to be subject to the local town and country planning regulations. So: the sign is compulsory, but so is its authorisation (notification)! There is no such thing as “small signs don’t need a permit” – the regulation applies to appearance.

Q: How much is the public land use charge?

V: It depends entirely on the location. For example, in the XI district of Budapest (Újbuda) or in the VIII district (Józsefváros), public spaces are divided into zones. In priority commercial zones, the fee can be as high as HUF 10,000 – 15,000/m2/month, while in side streets it can be a fraction of this amount. Bepro can help you make a preliminary calculation.

Q: Do you help to legalise existing but unauthorised signs?
